Yes, some plants are patented! The U.S. Patent and Trademark Office has offered legal protection to plant breeders for their new varieties since 1930, partly due to the lifelong work of “the Wizard of Horticulture,” Luther Burbank. The drawings accompanying plant patents are often as lovely as the plants themselves.
